(“ProjectMark”,“us”, “we”, or “our”) operateswebsites including www.projectmark.com (eacha “Website”) and mobile applications (together with our Websites,our “Online Platforms”) that allows (i) access to and download ofcertain information we provide through the Online Platforms and (ii) theability of users of our Online Platforms to use the services provided thereinand or to contact us electronically, including , transmission, storage, anddisplay of information from each user (collectively, the "Services").This document sets out our privacy and security policy (the “Policy”)and, among other things, informs you of our policies regarding the collection,use and disclosure of Personal Information (as defined below) when you accessany of our Online Platforms (whether directly or indirectly) or in any manneruse our Services.
By visiting any of our Online Platforms, by using our Services, or by in anymanner communicating with us via any of our Online Platforms or ourServices, you accept our practices described in this Policy, and youconsent to our collection, use and disclosure of your information, includingpersonally identifiable information, as described in this Policy. Ifyou do not wish to be bound to the practices and uses described in this Policy,do not access any of our Online Platforms or use our Services in any manner orfor any purpose.1. Except as expressly stated herein, this Policy does not apply to any thirdparty applications or technologies that integrate with our Services (e.g.,social media websites, etc.), or any other third party products, services, orbusinesses, or to third party websites that you access via links or otherwisewhile using the Online Platforms or our Services (“Third Party Services”). This Policy does not apply to data collected from, or provided by you to,Third Party Services, and instead such data is subject to the practices of theprovider(s) of the applicable Third Party Services. You should review theprivacy policies of such Third Party Services (and any other applicable termsand conditions) to determine how your data will be used before sharing any ofyour data with them.
This Policy is incorporated into and subject to the terms of our Terms &Conditions (available at https://www.projectmark.com/terms)posted on our Websites and available through our mobile applications(collectively, the “Terms of Use”).2. Information We Collect.
While using our Services, we may ask you to provide us with certain personallyidentifiable information that can be used to contact or identify you. You mayalso elect to send us information at your discretion about yourself or othersor otherwise post information through our Online Platform for public display.
Personally identifiable information may include, but is not limited to, youremail address, name, phone number, postal address, IP address, employer, jobtitle, and any other information that can in any manner identify youindividually ("Personal Information"). Forexample, before being able to collaborate on projects via our Online Platform,you will be required to provide information regarding your organization andelectronically provide your contact information, including your name, emailaddress and phone number.
Your information, including your Personal Information, and any otherinformation submitted via use of our Services such as, without limitation, rawdata, files, text, graphics, images, software, works of authorship, andinformation or other materials that you transmit to, upload to, transfer to,process on, store in, or cause to interface with, the Online Platforms(collectively, “Submitted Data”) may be collected by usthrough your direct interactions with our Online Platforms, use of our Servicesvia text messaging, email or written correspondence, telephone calls, messagingthrough our Services or web-based forms or from third party providers. Aspart of and to improve the Services provided to you, information thatis collected, including your and other users’ Personal Information andSubmitted Data, may be enhanced through certain contact enrichment informationwe obtain via lead-generation services, related offerings, or otherwise (“CEI”) from one or more third-party providers (each a “CEI Provider”) pursuant to separate agreement betweenProjectMark and said CEI Provider(s). Forpurposes of clarification, Personal Information does not include all SubmittedData.
We may also collect other information from you related to your use of theOnline Platforms or our Services and your interactions with our OnlinePlatforms or our Services (while this information may not typically containPersonal Information, we are not responsible for the content of suchinformation). This information includes any such information that youaffirmatively provide to us, and may include the following:
a. Log Data. Like most websites and web-based technology services,our servers may automatically collect data when you access or use our Servicesand record it in log files. Such may include your Internet Protocol (IP)address, Internet service provider (ISP), geographic location, browser type andsettings, information about browser plugins, language preference, default emailapplication, referring/exit websites, operating system, date and time stamp,cookie data, and certain user activities.
b. Technical Data. We may collect technical data, such asinformation about devices accessing our Services, including the type of device,device settings, operating system, application software, peripherals, andunique device identifiers, phone number, country, location, and any other datayou choose to provide. We do not intentionally relate this to any individualuser of our Services.
c. Cookies. Cookies are files with a small amount of data, which mayinclude an anonymous unique identifier. Cookies are sent to your browser from aweb Online Platforms and transferred to your device. We use cookies to collectinformation in order to improve our services for you. You can instruct yourbrowser to refuse all cookies or to indicate when a cookie is being sent. TheHelp feature on most browsers provide information on how to accept cookies,disable cookies or to notify you when receiving a new cookie. If you do notaccept cookies, you may not be able to use some features of our Services and werecommend that you leave them turned on.
Please be aware that our Online Platforms and our Services do not support DoNot Track ("DNT"). Do Not Track is a preference you canset in your web browser to inform websites that you do not want to be tracked.You can enable or disable Do Not Track by visiting the Preferences or Settingspage of your web browser.3. Use of Data We Collect.
The information we collect is used, generally, to provide our Services,identify and communicate with you (including sending you marketing messages),respond to your requests/inquiries, improve our services, and ensure compliancewith applicable laws, inclusive of all intellectual property laws. Wealso use Personal Information, to the extent necessary, to enforce the Terms ofUse, monitor adherence to the Terms of Use, to attempt to prevent and/or detectfraud, to allow third parties to carry out technical, logistical or otherfunctions (including providing contact enrichment information and other CEIfrom CEI Providers) on our behalf as long as those third parties have agreed touse the level of privacy protections commensurate with industry norms, and tohelp prevent and investigate security issues and abuse. Moreover, much ofour Services are designed to allow users to share information amongst eachother. That information, by definition, is made public through our OnlinePlatforms. Examples of our use of your information include, by way ofexample, the following:
● Communications. We may use your PersonalInformation to contact you with marketing or promotional materials and otherinformation that may be of interest to you. You may opt out of receiving any,or all, of these communications from us by following the unsubscribe link orinstructions provided in any email we send.
● Compliance with Laws. We will disclose your PersonalInformation where required to do so by law or subpoena or if we believe thatsuch action is necessary to comply with the law and the reasonable requests oflaw enforcement or to protect the security or integrity of our Services.
● Analytics. In connection with our use of cookiesdescribed above, we may also partner with third party providers, as describedbelow, to allow tracking technologies and remarketing services related to ourServices through the use of first party cookies and third-party cookies, to,among other things, analyze and track users’ use of our Services, and to betterunderstand online activity. By accessing our Services, you consent to thecollection and use of your information by these third-party vendors. Youare encouraged to review such vendors’ privacy policies and contact themdirectly for responses to your questions. While we do not transferPersonal Information to these third-party vendors, if you do not want anyinformation to be collected and used by tracking technologies, you can installand/or update your settings to control such use.
● Security Purposes. Using information collected tohelp prevent and investigate security issues and abuse and to ensure compliancewith this Policy and the Terms of Use.
● Improving Our Services. We may use your informationto test features, manage landing pages, heat mapping, traffic optimization,data analysis and research, including profiling and the use of machine learningand other techniques over your data and in some cases using third partyproviders (including CEI Providers) to do this.
● Providing our Services. As mentioned above, much ofour Service is specific to providing a communication platform between members. When members share information with each other or otherwise publiclydisplay/post information through our Online Platforms, that information, bydefinition, is available to anybody accessing our Services and is part of theServices we provide.4. Use of Third Parties and Third PartyServices.
We may employ third-party companies and individuals to facilitate our Servicesand manage our Online Platforms and to provide our Services on our behalf.These third parties may have access to Submitted Data and/or PersonalInformation only to perform specific tasks on our behalf and are obligated notto disclose or use your information for any other purpose. Moreover, we may usethird-party services, such as, and by way of example only, Amazon WebServices, Amplitude, Anthropic, Datadog, Google Analytics, Google Maps,Mailgun, OpenAI, Prismatic, and Stripe that collect, monitor, filter, and/oranalyze this type of information in order to attempt to increase our Services’functionality, monitor the effectiveness of our Services, improve our Servicesand their quality, provide contact enrichment information and other CEI, and/oraid us in communicating with our users effectively. These third parties may useor entail cookies, pixels, AI platforms, and similar technologies to help usanalyze how our users are using our Services and to improve the quality of theServices, and they have their own terms of service and privacy policiesaddressing how they use such information. By using our Services, you consent toour use of third-party companies (whether or not such companies are enumeratedherein) and agree to each of their terms of service and privacy policiesaddressing how they use information they may access related to our Services.
